The agreement between you and Kincharts when you use kincharts.com or the Kincharts app, in plain language.
In short
Not medical advice. Kincharts organizes and explains records. Decisions stay with the doctors.
Only what you may share. Add someone's records only when you have the right to.
Owners decide. A Kinchart's owners choose who can see it and what each person can do.
Free, as is. Kincharts is free today and comes without guarantees.
Using Kincharts
By creating an account or using Kincharts, you agree to these terms and to the Privacy Policy. Kincharts is run by Bharat Kilaru; “we” means Kincharts. You need to be 18 or older to create an account. If you don't agree, please don't use Kincharts.
Not medical advice
Kincharts, including Kincharts AI, helps families organize and understand medical records. It doesn't diagnose, treat or give medical advice, and it isn't a substitute for a doctor. Explanations and summaries, especially those written by AI, can be incomplete or wrong. Check anything important against the original record and with the care team, and never delay or skip care because of something you read in Kincharts. In an emergency, call 911 or your local emergency number.
Your account
Use your real name and an email address or phone number you control, and keep your sign-in secure. You're responsible for what happens under your account. Tell us at bkkilaru@gmail.com if you think someone else is using it.
Kincharts and their members
Whoever starts a Kinchart is its first owner. Owners invite people and choose their role: owners manage people and settings, editors add records and record answers, and viewers read, leave notes and ask questions. Invite only people who should see the person's health information. Owners can change roles or remove people at any time, and people who are removed lose access. Every Kinchart keeps at least one owner.
Your content
You keep ownership of what you add. You give us permission to store, copy, process and display it, including sending it to the AI and other providers listed in the Privacy Policy, only as needed to run Kincharts for the people you share it with. That permission ends when the content is deleted, apart from copies in short-term backups.
You confirm that you have the right to add what you add: it's your own record, the person it describes has agreed, or you're their caregiver or legal guardian.
Acceptable use
Don't add anything illegal, or anything you don't have the right to share.
Don't try to get into a Kinchart you weren't invited to, or into anyone else's account.
Don't harass, threaten or impersonate anyone.
Don't interfere with Kincharts: no malware, scraping, automated sign-ups, overloading, or probing for weaknesses without our permission.
Don't use Kincharts AI to create content that's harmful or misleading.
Changes and availability
Kincharts is free today, and we'll tell you before charging for anything. We may change, add or remove features, and Kincharts may sometimes be unavailable.
Ending
You can stop using Kincharts and delete your account at any time from the Account page. We may suspend or close an account that breaks these terms or puts others at risk, and we'll tell you why where we can.
Disclaimers
To the fullest extent the law allows, Kincharts is provided “as is” and “as available”, without warranties of any kind, including that it will be accurate, uninterrupted or error-free, or fit for a particular purpose.
Limitation of liability
To the fullest extent the law allows, Kincharts isn't liable for indirect, incidental, special, consequential or punitive damages, for lost data, or for decisions made based on anything in Kincharts. Our total liability for any claim about Kincharts is limited to $100. Some places don't allow these limits, so they may not apply to you.
The iPhone and iPad app
If you get Kincharts from Apple's App Store, these terms are between you and Kincharts, not Apple. Apple isn't responsible for the app or for supporting it, and the App Store's own terms also apply. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
Changes to these terms
When these terms change, we'll update the date at the top, and we'll tell you by email or in Kincharts before a significant change takes effect. Using Kincharts after a change means you accept the new terms.
